These are the terms for buying from ACW Garden Centre online or over the phone. We’ve kept them as short and plain as we can. Please read them before you order. Nothing here affects your legal rights as a consumer.

1. Who we are

ACW Garden Centre is run by ACW Garden Centre LLP, a limited liability partnership registered in England and Wales (registered number OC340899), of Canal Road, Bradford, West Yorkshire BD2 1AL. In these terms “we”, “us” and “our” mean ACW Garden Centre LLP, and “you” means the person placing the order.

You can contact us on 01274 392344, by email at orders@acwgardencentre.com, or at the garden centre.

2. Placing an order

  • Our online shop is for customers aged 18 or over in the UK, and our delivery service covers addresses within around 15 miles of the garden centre.
  • When you place an order we’ll email you to confirm we’ve received it. The contract between us starts when we send that order confirmation.
  • Please check your order, delivery address and phone number carefully before you pay. If you spot a mistake, call us as soon as possible.
  • We may decline or cancel an order, for example if an item is out of stock, your address is outside our delivery area, or there’s an obvious error in a price or description. If we do, we’ll let you know and refund anything you’ve paid in full.

3. Prices and payment

  • Prices are in pounds sterling and include VAT where it applies. The price you pay is the price shown when you place your order, plus any delivery charge shown at checkout.
  • Online payments are taken securely by our payment provider, Stripe, when you place your order. We never see or store your full card details (see our Privacy Policy).
  • If a price on our website is obviously wrong, we’ll contact you before your order goes any further, and you can choose to go ahead at the correct price or cancel for a full refund.

4. Stock and product details

  • We do our best to keep stock levels on the website up to date, but our stock is shared with the garden centre. If something you’ve ordered has sold out, we’ll tell you as soon as possible and refund you in full for that item, or offer an alternative if you’d like one.
  • Product photos are for illustration. Natural products such as real Christmas trees and plants vary in shape, colour and fullness, so yours won’t look exactly like the photo, but it will match its description and size.
  • Sizes are approximate. Real tree heights are measured roughly and can vary slightly.

5. Delivery

  • We deliver within around 15 miles of the garden centre. The delivery charge depends on your postcode and is shown at checkout, and our current prices and offers are on our Delivery & collection page.
  • We’ll be in touch to arrange delivery. Unless we agree a different date with you, we’ll deliver within 30 days of your order.
  • Someone aged 18 or over needs to be in to take delivery. If nobody’s in, we’ll get in touch to rearrange, and we may charge for a second delivery if a missed delivery wasn’t our fault.
  • Please check your order when it arrives and tell us straight away about anything missing or damaged.
  • Your goods are our responsibility until they’re delivered to you (or collected). They become yours once we’ve received full payment.

6. Click & collect

  • Click & collect is free. We’ll let you know when your order is ready to collect from the garden centre on Canal Road during our opening hours.
  • Please bring your order confirmation. If someone else is collecting for you, let us know their name.
  • Please collect your order within 14 days of us telling you it’s ready (cut real trees within 3 days, as they’re perishable). If you can’t, give us a ring. If we can’t reach you and an order isn’t collected, we may cancel it and refund you, less any reasonable costs we’ve had.

7. Cancelling and returns

For orders placed online or by phone, you can change your mind and cancel within 14 days of receiving your goods. Cut real Christmas trees are perishable and can’t be returned if you change your mind. Full details, including how to cancel, getting items back to us and collection charges, are in our Returns & Refunds Policy.

8. Faulty goods

We’re required by law to supply goods that are as described, fit for purpose and of satisfactory quality. If something is faulty, you have legal rights to a repair, replacement or refund. See our Returns & Refunds Policy for how this works. For more about your rights, contact Citizens Advice.

9. Our responsibility to you

  • If we break these terms, we’re responsible for loss or damage you suffer that is a foreseeable result of that. We’re not responsible for loss or damage that isn’t foreseeable.
  • We don’t exclude or limit our liability where it would be unlawful to do so, including for death or personal injury caused by our negligence, for fraud, or for breaking your legal rights in relation to the goods.
  • We supply goods for domestic and private use. If you buy for business purposes, we’re not liable for any loss of profit, business or opportunity.
  • We’re not responsible for delays or failures caused by events outside our reasonable control, such as severe weather. If that happens we’ll let you know and do what we can to keep the delay to a minimum, and you can cancel for a refund if the delay is long.
  • Please follow the instructions that come with products, especially for electrical items such as pre-lit trees and lights.

10. Your personal information

We only use your personal information as set out in our Privacy Policy.

11. Problems and complaints

If there’s a problem with your order, please get in touch on 01274 392344 or at orders@acwgardencentre.com and we’ll do our best to sort it out quickly.

12. Other important terms

  • We may update these terms from time to time. The terms that apply to your order are the ones on our website when you placed it.
  • If a court decides part of these terms isn’t valid, the rest still apply.
  • These terms are governed by the law of England and Wales. You can bring legal proceedings in the courts of England and Wales, or, if you live in Scotland or Northern Ireland, in the courts there.
